What Is an Authorization to Return to Canada?

An authorization to return to Canada (ARC) is a document any individual who has received a removal order from Canadian immigration services most likely needs, though, there are exceptions. In other words, an ARC is needed for any individual who travels to Canada and fails to comply with the requirements set out in the Immigration and Refugee Protection Act (IRPA). One can fail to comply with the requirements set out in IRPA by staying longer than the standard 6 months individuals are allowed to stay, or longer than is permitted according to their visitor’s visa in their specific circumstance. One can also violate IRPA regulations by working or studying in Canada while they are not permitted to do so, for example. Violating the regulations set out in IRPA do not simply trigger your removal from Canada, it is most likely that following this occurrence, you will require an authorization to return to Canada before you are allowed to enter the country. To be clear, you are often considered inadmissible to Canada if you violate the regulations of the IRPA. An ARC overcomes your status as inadmissible if you are inadmissible as the result of a removal order.

What is Authorization to return to Canada (ARC)?

Not to be confused with Temporary Resident Permits (TRP), Authorization to Return to Canada, also known as ARC is the process one has to go through if they have previously been removed from Canada. There are three ways in which you can be removed from Canada, the first being a Deportation order, followed by Exclusion Order and the last being a Departure Order. As mentioned earlier, do not confuse the authorization to return to Canada with a TRP. A TRP, the abbreviation for the term “temporary resident permit”, is a makeshift permit that grants you entry into Canada if you have an inadmissibility issue such as DUI, felony, misdemeanor etc. ARC applications are for individuals depending on the type of removal order they got based on that it can be determined what you need to apply for. For example, if you had come to Canada as visitor, student or worker and you overstayed your welcome stay then you would need to apply for an ARC application as you violated an immigration rule. Another example would if you misrepresented yourself meaning you lied on your application or withheld information from an immigration officer. Also if you were removed for health reasons from Canada you would need to apply for ARC application. The main difference between a TRP and an ARC is the reasoning behind each stay. For a TRP, you are insisting on residing in Canada for a specific period of time whereas for an ARC, you are asking permission to return to Canada because the Canadian government has previously removed you. Authorization to return to Canada, likewise its name, is the approval you have to get from the government to be able to enter the country again.

How to Re Enter Canada

Authorization to Return to Canada

Those who are looking to re-enter Canada will require a prior authorization to do so. This authorization is applicable to people who have a Canadian visit visa, or received any of the three removal orders. Those that entered Canada on a visit visa need to get authorization at the time of leaving to re-enter Canada. If you have received a removal order from Canada, then you need and Authorization to Return to Canada (ARC) in order to come back into Canada.

There are three types of removal order:

Departure order:

A person who receives a departure order would be told to leave Canada within 30 days. If a person leaves Canada within that time period and verified their departure with a Canadian Immigration Officer at the port of exit then they do not need an Authorization to Return to Canada ARC for future. They can simply return after a normal examination at the port of entry. However, if the person left Canada without verifying their departure or after the 30 day deadline then the departure order becomes a deportation order and would require an ARC to re-enter Canada. A departure order is issued for a less serious violation of immigration law.

What is ARC?

ARC is authorization to return to Canada. It is needed when someone was once in Canada, then they were asked to leave using one of the three removal orders we have, and now they want to come back into the country. There are three types of removal orders in Canada: departure order, exclusion order and deportation order.

Departure Order

Departure order gives you the choice to leave Canada voluntarily or else you will be forced to leave Canada. If you had received a departure order and you left Canada within the required 30 days, and you verified your departure with a Canadian immigration officer at the port of exit, you do not need ARC. However, if you left the country without verifying your departure, or you left more than 30 days after the order was issued, the departure order automatically becomes a deportation order and you would need to apply for an ARC.
