Determining Eligibility for Self Employed

To be found eligible as a self-employed person in Canada, you must:

  • Have relevant experience and intend to be and must be self-employed in Canada,

  • Meet the selection criteria for self-employed people, and

  • Meet medial, security and other conditions

    Relevant Experience

    As a self-employed individual, your experience is found to be relevant if you have:

  • Taken part in cultural activities or athletics at a world-class level,

  • Been self-employed in cultural activities or athletics, or

  • Experience managing a farm

    There are many different qualifications to find someone to have relevant experience, but generally, a self-employed person needs at least two years of experience in one of the three classifications stated above.

    Selection Criteria

    CIC (Citizenship and Immigration Canada) will assess you on selection criteria, which include these five factors:

  • Experience,

  • Education,

  • Age,

  • Language abilities, and

  • Adaptability

    In order to qualify as self-employed persons, you must meet the definition of an self-employed person. These five selection criteria are assessed using a point system and you need to obtain a minimum of 35 points out of 100, if you wanted to immigrate to Canada as a business immigrant. The pass mark of 35 is always subject to change, depending on the laws set by CIC.

    When being assessed for eligibility under the selection criteria, you may be asked to do an interview. A visa officer will conduct the interview and they may ask you to explain any information that they find to be unclear or inconsistent or they may ask you to clarify any shortcomings or gaps in the documents that you had provided. If there is a discrepancy or difference between the assessment of your qualifications made by you and the visa officer’s assessment, the officer assessment will prevail when determining your eligibility.

    Medical, Security and Other Conditions

    The third factor when considering whether an individual is eligible or not, is the medical, security and other conditions that the CIC have put in place as a qualification. This condition requires the individual and their family members to have medical exams and police certificates done for their application. One of the conditions is that you cannot use your own doctor to do the medical exam; you must find a panel physician that has been approved by Citizenship and Immigration Canada. The police certificate, also known as a police check, needs to be done for everyone in the family to find out if anyone has a criminal record and to help ensure the visa officers that you are not a security risk to Canada.

    Another condition is that you must be able to show that you have enough money to support not only yourself, but your family as well, after you get into Canada.
