Generally speaking when a foreign national wishes to study in the country of Canada they are subjected to getting a study permit, however there are some exceptions to the rule. For example if you wish to only study in Canada for a short period of time (six months or less) then one does not need a study permit. However if the program of study in which the applicant chooses exceeds the six month window given to those without a study permit, they must return to their home country. Failure to do so can result in detention, deportation, as well as possibly new immigration barriers for the individual, in future.
Another way around the study permit applies to those who are a family member or staff member of a foreign representative accredited by Global Affairs Canada (GAC). In this situation the best course of action is to contact your respected embassy in Canada, as they will be able to tell you whether or not your unique circumstance requires a study permit or not.
Members of foreign armed forces visiting under the Visiting Forces Act, do not need a study permit however family members of said individuals, including children under 18 who wish to study in Canada must meet all the necessary requirements.
The final exception for those who possibly don't need a study permit are Foreign nationals who have registered Indian status in Canada.
When applying for a study permit it is very important that you have prepared the strongest and most compelling legal argument to demonstrate your intent to Canada is temporary and will exit Canada once your permit expires. There are a variety of factors that affect foreign national students but the biggest one is the time restrictions facing students who are looking to apply for international study. Due to these time restrictions it is imperative to ones success that you seek legal support when compiling the necessary documents and filling out the required documentation. Often times the deciding factor for these applications is something as small as a missing signature, date, using an old form and to not be able to study abroad for something seemingly so small is unjust… but we see it almost every day!
