Canada has a vast range and number of Colleges and Universities with some of the best education available throughout the world. It is very common for students from other countries to want to come into Canada and study here. Moreover, as soon as you receive your letter of acceptance, you may begin your application for a study permit.
The study permit may make a student eligible to work in Canada while they are studying or after they graduate. If your training for school or your program requires an essential co-op or internship component, you will need to apply for a work permit.
Must have been accepted by a designated learning institution in Canada,
Must prove that you have enough money to pay for:
Tuition fees,
Living expenses for yourself or any family members who are coming with you to Canada and
Return transportation for yourself and any family that had come with you.
Must be a law-abiding citizen with no criminal record and you must not be seen as a risk to the security of Canada (may have to provide a police certificate),
Must be in good health and willing to complete a medical examination, if necessary, and
Must satisfy an immigration officer that you will leave Canada and go back to your country of origin at the end of the authorized stay.
Exemptions to getting a study permit, some may be able to study in Canada without getting a study permit:
If the course or program is short term, if it is lasts 6 months or less,
If you are a family member of a foreign representative to Canada,
If you are a member of foreign armed forces,
Registered Indians as long as they are a citizen of another country who has Registered Indian status in Canada.
Additional information that may be required of you is a medical examination and security information. In most cases, you will need a medical examination; a visa officer will send you instructions if you do need one. Anyone coming to Canada, and any family members coming with them, everyone over 18 years old may need to provide police certificates. The length of time to process your application will vary on the visa office where you applied.
After getting the study permit and going to school in Canada, you can apply for a post-graduate work permit to continue working in Canada after graduation if that is what you wanted. With the study permit, if you are changing schools and programs in post-secondary, you are required to amend your study permit without having to apply for a new one.
If you wanted to leave Canada and return, you must always have the valid documentation to get back into the country; a passport, study permit, eTA, and a visitor visa (if you are a citizen of a visa-required country).
Because the application process time varies, it is best to apply as soon as you receive your letter of acceptance.
If your visa is expiring and you would like to extend your stay as a student, you must apply for a new temporary resident visa. If your study permit is expired and your application has been submitted but you received a decision on your application, you can stay in Canada under a status called implied status. This means that the law is implying that you are a temporary resident. Conditions of your study permit must still be followed. You cannot quit school if you are on the work permit. If you do so, you will be sent back to your home country.
You are allowed to work while studying in Canada. You must, however, ensure that you meet the specific criteria and continue your studies. If your program requires co-op or an internship, a work permit is needed. If you wish to continue working after graduation, you may apply to a post-graduation work permit.
If any information, such as your address, telephone number, or any other information has changed after your application has been submitted, it is important that you notify the visa office.
you did not show enough proof that you are financially capable of supporting yourself while studying in Canada
you did not pass the medical examination, if required
you did not satisfy the visa officer that your intentions were to solely study in Canada
you did not satisfy the visa officer that you will leave Canada at the end of your study period.
If your application is approved, you will receive a temporary resident visa in your passport. You will also obtain a letter of introduction confirming the approval. Once you receive your temporary resident visa, you will be good to go.
As of March 15, 2016, visa-exempt foreign nationals are expected to have an eTA which is an Electronic Travel Authorization that allows individuals to fly or transit through Canada. eTa is created to screen travellers before they arrive into Canada. If you have received your study or work permit before July 31, 2015 you are expected to have an eTA as of March 15, 2016 to fly or transit to Canada. If you do not have eTA from March15,2016 until fall of 2016 you can board your flight as long as you bring your proper travel documents such as a passport.
If you have applied for study or work permit on or after August 1, 2015 you will automatically be issued an eTA along with your permit.
The eTA will NOT automatically renew itself when applying for renewal application for work or study permits. If you want to exit and re-enter Canada by air you have to make sure your eTA is valid. If your eTA has expired, you need re-apply for a new one as soon possible.
If you like to remain longer in Canada as a student you can either complete the application called “Application to Change Conditions” or “Extend Your Stay” in Canada. You have to remember to check the expiry date on your study permit and to complete the application forms prior to the expiry date on your study permit. It is recommended to apply at least 30 days before your permit expires. If you are younger than 17 years of age and studying in Canada without a parent or legal guardian you need to complete and include the Custodianship Declaration (IMM 5646) with your study permit application.
If you continue to meet the requirements under a study permit and have met all the conditions imposed on your study permit, you may eligible to restore your status as student as long as it is done within the 90 days of losing it.
Once you apply for restoration you can stay in Canada until you get a decision on your study permit application. During the waiting period you are not allowed to study until your status has been restored.
Restoration is not guaranteed therefore you must provide all the details of facts and circumstances that made you lose your status. You have to provide all supporting documents to make sure your application does not get returned for missing documents or information.
Don’t forget to pay the fee for restoration which is separate from the renewal fee for study permits.
