Putting the Safety and Security of Canadian First

The Minister of Citizenship and Immigration of Canada (CIC) declared changes under the Faster Removal of Foreign Criminal Act. The purpose of these changes is to protect Canadians and the integrity of Canada’s immigration system. The first priority of Canadian government is the safety and security of Canadians.

Some applicants are inadmissible on the basis of criminality. Inadmissibility means an applicant is not eligible to immigrate to Canada or they are not allowed to enter Canada. There are a number of reasons someone might be considered inadmissible to Canada, including previous criminality.

The Faster Removal of Foreign Criminal Act will help to remove the foreign criminal from Canada more quickly. The Act makes it more difficult for the applicants to enter into Canada who are not eligible to immigrate because of criminality. These new rules also help to stop the abuse of the Canadian immigration system and safeguards Canadians. The new changes are followings:

  • The new rule is stricter on misrepresentation. If you apply for permanent residence and provide false information to Citizenship and Immigration Canada that can lead to serious consequences. According to new rule Citizenship and Immigration Canada has increased the penalty for misrepresentation from two to five years of inadmissibility. Meaning that those who misrepresent are banned for five years which means you cannot apply for permanent resident status let alone enter Canada five years.
  • The new rule also excludes the temporary entry of family members of that person who is inadmissible. If an applicant is inadmissible on the grounds of national security, human or international rights violations or organized criminality, then their family members or any relatives are also inadmissible. The reasoning is to prevent family members of a person who potentially inadmissible to use their family to enter Canada.

If you or your family members face an inadmissibility issue, contact us. There are ways to overcome inadmissibility and still have your application processed. A representative would be happy to discuss more with you.
