Qualifying for a Study Permit

In order to acquire a study permit you must demonstrate a number of different factors to an immigration officer assessing your application. Secondly, as you are applying for a temporary status document you must satisfy an officer above all else that your stay in Canada is indeed, temporary in nature.

In addition to the above, you will need to meet the requirements of the below:

  • you must demonstrate that you have enough money to maintain yourself and your family members, should they be accompanying you, while you are in Canada as well as sufficient funds to return home;
  • You must prove your identity;
  • you must be law-abiding and have no record of criminal activity;
  • not be a risk to the security of Canada or Canadian citizens; and
  • be in good health

you may be required to provide any additional documentation requested by an immigration officer assessing your application in order to determine whether not you will be allowed to enter Canada

Application Process

Processing times will depend on the Canadian visa office where you submitted your application. The visa office will review your application to make sure you have completed it correctly and have included all the required documents. If your application is incomplete, it will not be processed it will be returned to you.

It is generally understood that you should apply for your study permit at least 3-6 months in advance of your intended studies to ensure that your visa is processed in time for the start of your schooling. If you do not have your study permit on time, you will not be allowed to study in Canada.

Extend Your Study Permit

If you are continuing your studies in Canada, you have the option to extend your study permit based on that continuing education. However, the same requirements would essentially apply:

  • You will need to demonstrate your success in the previous year;
  • That you have been enrolled in the next year of studies;
  • You have enough money to support your stay in Canada;
  • You have enough money to pay for your tuition.

Off Campus Work Permit

If you obtain your Study Permit, you are also eligible to obtain an Off Campus Work Permit that will allow you to work a specified amount of hours off campus. An Off Campus Work Permit is unique in the sense that it allows a student to work for any eligible employer in Canada, this is known as an open work permit.

To qualify, you must be a full-time student enrolled at a participating publicly funded post-secondary educational institution or in an approved program at an eligible privately funded institution.

To work off campus, you must first apply for your work permit and follow a similar process. Do not begin to work off campus until you have received your work permit. The work permit authorizes you to work up to 20 hours per week during regular academic sessions, and full time during scheduled breaks (for example, winter and summer holidays, and spring break).

A work permit does not guarantee that you will find a job. It is your responsibility to look for work. Even if you work off campus, your studies must be the main reason you are in Canada.

What You will Need

In order to come to Canada as a student, you will need to first obtain your study permit. As such, you will need to also satisfy an officer that you are a bona fide temporary resident, meaning:

  • You have strong ties to your home country and will not remain in Canada beyond your authorized period of stay;
  • You have enough funds to support yourself while you are in Canada;
  • Your purpose in Canada is that of a visitor;
  • You will exit Canada once your stay is over.

You will need to demonstrate these above requirements in addition to meeting the requirements of a study permit.

Do I Need A Study Permit If I Have A Temporary Visa?

You may be allowed to take a program that is less than 6 months, and does not lead to degree or diploma without a Study Permit. Any study program longer than 6 months would require you to apply for a Study Permit, which is separate from a Temporary Resident Visa.

Usually people who are not Canadian citizens or Permanent Residents of Canada would require a TRV, unless they are from a visa exempt country. In order for you to gain entry into Canada with a TRV, you need to satisfy the officer of the fact that you are here on a temporary bases.

There is a list of documentation you could provide in order to make your application stronger, and increase your chances to enter Canada. A TRV only allows you to visit Canada for a temporary basis. Visitors who enter Canada with a TRV are usually restricted in the length of their stay, which is a maximum up to 6 months.

On the other hand, if you apply for a Study Permit, you may still require a TRV, but the length of your stay is extended according to the study program you are enrolled in. One of the main requirements for applying for a Study Permit is a letter of acceptance from a Designated Learning Institution (DLI). You may be required to prove that you will be leaving at the end of your study programs.

Can I Work While Studying In Canada?

If you are studying in Canada you may eligible to work on-campus or off-campus without a work permit. However, you have to meet the some specific requirements to do so.

Off-campus work:

If you are studying in Canada, you may eligible to work off campus without a work permit. Your study permit allows you to work up to 20 hours per week during regular academic sessions which means you can work up to 20 hours while you are going to school, college, and university full-time.

You can also work full-time when you have full-time schedule breaks, such as winter break, and summer holidays or spring breaks.

In order to qualify for off-campus work you have to have following:

  • You have a valid study permit
  • You are a full-time student
  • You are enrolled in a designated learning institution at the post-secondary level or, in Quebec , a vocational program at the secondary level
  • You are studying in academic, vocational or professional training program that leads to a degree, diploma, or certificate that is at least six months in duration.

You do not need to have a work permit to work off-campus work. However, you need to apply for social insurance number. When you apply for social insurance number at service Canada, you may need to provide the confirmation to work off-campus document issued by Citizenship and Immigration of Canada (CIC). In order to obtain confirmation document you have to meet the above requirements.

On-campus work:

You can also work on campus while you are studying and you do not need a work permit. In order to work on campus you have to meet the requirements and those are:

  • You have a valid study permit
  • You are full time student at a public post-secondary institution, or
  • A Canadian private institution authorized by provincial statute to confer degree

Apply for a Study Permit

If you wish to study in Canada, you will most likely be required to apply for a study permit. Like most immigration programs, there are a few steps in the application process that is worth discussing.

  1. Gathering your documents
  2. Completing the application
  3. Paying your application fees
  4. Submitting the application

Before getting to these steps, it is important to know that some exemptions exist in terms of a study permit including,

  • If you are taking short-term courses that are six months or less
  • If you are the family member or private staff of a foreign representative accredited by the Department of Foreign Affairs, Trade, and Development Canada
  • If you are members of the armed forces of a country designated for the purposes of the Visiting Forces Act

If these situations do not apply to you, you will require a study permit.

When you begin an application, there are lists of documents that must be collected. You can use the document checklist as a guide when you are doing so. Depending upon where you are coming from, there may be some country-specific materials that need to be submitted.

In terms of the forms itself, there are various forms that will need to be completed such as,

  • The Application for Study Permit Made Outside of Canada
  • The Family Information Form
  • The Statutory Declaration of Common-Law Union, if applicable

Once you have completed all your forms and gathered all the correct materials, you will need to pay the processing fee. It is important that you pay the correct amount or your application will be returned to you or be delayed until the correct amount has been received.

How To Get A Study Permit

Before applying for a student permit you must check you eligibility first. To be eligible to study in Canada:

  • You have to be accepted by a designated learning institute in Canada.
  • Must prove that you have enough money to pay for
  • Tuition fees
  • Living expenses for yourself and any family members who come to Canada with you
  • Return transportation for yourself as well as for the family that came with you
  • Must be a good citizen who abides the law with no criminal record
  • Must be in good health and willing to complete a medical examination if needed
  • Must convince immigration officer that you will leave Canada at the end of authorized stay

After checking your eligibility you must get the right documents. To apply for a study permit you need the following documents:

  • Proof of acceptance: along with your study permit application you must include the original letter of your acceptance that the college or university has sent you
  • Proof of identity: you must provide a valid passport or travel document that allows you to return to the country that issued it. Citizens of US, St. Pierre and Miquelon, and Greenland do not need a passport but need proof of status and citizenship. Two recent passport sized photo. The name and birth of the person should be written in the back.
  • Proof of financial support: you must prove you can have the sufficient funds to support yourself. Proof can include:
  • Proof of Canadian bank account in your name if money has been transferred to Canada
  • Proof of student/education loan from a financial institutions;
  • Bank statement from the past four months
  • Bank draft in in convertible currency
  • Letter of explanation: there are benefits of having study permits even if you don’t need one. You can be able to work part time or full-time. If you are applying for a study permit for that reason you must write a letter explaining why you are applying for a study permit.

Application to Extend Study Permit

If your Study Permit will be expiring, you may wish to know how to extend your Study Permit. A few things to note are the new rules that have been implemented regarding those who wish to study in Canada. Some of these new rules include,

  • Limiting the issuance of study permits
  • Requiring students to actively pursue their studies while in Canada
  • Allowing certain classes of students to work part-time off campus and full-time during scheduled school breaks without a work permit

These new rules were implemented in order to reduce the risk of fraud or the misuse of the program. The government of Canada wants to ensure that those who come through the study permit program intends to do so and wants to pursue a meaningful education.

To apply for extension of your Study Permit, you must complete the Application to Change Conditions or Extend your stay in Canada. It is important that you apply at least thirty days before your current permit expires.

There are two ways in which you can make your Study Permit Application:

  • Online
  • On paper

If you wish to apply online, you must have access to a scanner or camera in order to make copies of the documents you will have to submit. A credit card will also be needed to make payments online.

If you complete the application by paper, you will have to download the application package that can be found on the Citizenship and Immigration Canada website.

Some information you should keep in mind about Study Permit is that:

  • You cannot extend your Study Permit beyond your passport expiration date
  • You can continue to study after the expiry date if you have submitted an application and are waiting for a response
  • If your permit has expired and you have not applied for an extension, this application is not applicable to you; you may wish to restore your status
