Live-in Caregiver Program

Ways to Qualify as a Live-in Caregiver

Qualifying for Permanent Residence under the Live-in Caregiver Class is a matter of having obtained valid work experience in Canada as a live-in caregiver for at least two years.

The basic qualifications for Permanent Residence through the Live-in Caregiver Program are:

  • Be approved to participate in the Live-in Caregiver Program at a visa office outside of Canada;
  • Have a valid work permit to work as a Live-in Caregiver for children, seniors or the disabled with a valid employer in Canada; and

Alternatively, you may also:

  • Complete a total of 3,900 hours:
  • within a minimum of 22 months which may include a maximum of 390 hours of overtime of authorized full-time employment as a live-in caregiver
  • within four years from the date you entered Canada under the program.

Medical and Security Checks

Aside from this and the required list of documents, you will also have to undergo police and medical checks.

In order to obtain a medical exam, you will need to go to a panel physician. A panel physician is one designated by Citizenship and Immigration Canada to perform such exams. Unfortunately, not just any doctor will do. The results of your exam will be send directly to Citizenship and Immigration Canada for assessment.

Police clearances are obtained by contacting your local police authorities and following their process to obtain said checks. Each authority is different so be sure to contact them directly to find out what they require in order for you to obtain the documentation you will need.

Depending on your medical and police history, you may be found either admissible or inadmissible based on the outcome. If you are found inadmissible, you may require further authorization to enter Canada; this document is known as a Temporary Resident Permit.

Applying with Family Member(s)

You can also apply with your family member for permanent resident of Canada. All family members of yours who have applied for permanent residence must be declared and included in your live-in caregiver’s application for permanent residence.

All family members, whether accompanying the principal applicant or not, are required to be examined. All eligible family members must undergo and pass medical, criminal and security checks.

Inadmissible family member can cause your application for permanent resident to be denied, so in order for you to make sure your application process to be easy, you have to find out whether your family member admissible or not before applying for the permanent resident with your family member.

What can affect your Permanent Resident application?

Your application is affected if:

  • You, your spouse or common-law partner, or any of your family members have a criminal record or a serious medical problem.
  • You did not provide truthful information about education, training or experience to the visa officer when you first applied under the Live-In Caregiver Program, your application can be cancelled.

The only thing that does not affect your PR application not affected are your financial situation, skills upgrading in Canada, volunteer work, marital status or the number of family members you have in your home country.

Processing time for your PR application can take up to 39 months regardless of your location in Canada other than Quebec.

Employer Responsibilities

If you want to hire a caregiver, before you look for foreign national caregiver you have to find a Canadian or permanent resident caregiver. If you cannot find any of them, you can look for foreign national caregiver and hire eligible foreign national caregiver. However, you have to show your efforts to find a Canadian or permanent resident caregiver. So it is an employer’s responsibility to show recruitment efforts.

It is an employer’s responsibility to apply for Labour Market Impact Assessment (LIMA) with Service Canada and obtain a LIMA. Service Canada works with Employment and Social Development Canada (ESDC) to provide LMIA to an employer.

It is an employer’s responsibility to shows his or her income by providing the Notice of Assessment from Canada Revenue Agency which proves that an employer is able to pay the caregiver the prevailing wage.

The employer also has to provide documentation to show a foreign national caregiver is eligible for the live-in caregiver program and meets the minimum requirements of the live-in caregiver program.

An employer also has to provide an appropriate living space to a caregiver should the caregiver reside in the employers home.

The employer must also make a job offer for the caregiver outlining the caregiver’s job duties.

The employer and caregiver must sign a written employment contract which shows that the employer and the caregiver agree on the working conditions and wage. The written employment contract includes job duties, wages, an accommodation arrangement including room and board, holiday or sick leave entitlement, termination and resignation terms, medical insurance coverage until caregiver eligible for provincial health insurance, workplace safety insurance for the time period of employment, and transportation to Canada from caregiver country of permanent residence.

If you have been working in Canada as a Live-in Caregiver, you have obtained the necessary authorization to work in Canada and obtain valuable work experience in the field.

Once you have obtained the necessary amount of time working in Canada, you can qualify to obtain your permanent resident status in Canada.

The Live-in Caregiver Program takes into account your valuable contribution to Canada and offers the ability for you to remain in Canada permanently through two options, depending on the nature of your time worked in Canada.

The two options are:

1. Having completed 24 months of authorized full-time employment as a live-in caregiver within four years from the date you entered Canada under the Live-in Caregiver Program, OR
