What is a Super Visa?

The super visa is a special visa drafted by the Canadian immigration specifically for parents and grandparents of Canadian citizens of permanent residents. A super visa is a temporary document that allows parents and grandparents to live in Canada for up to two years per every visit for ten years. In order to gain this visa you must meet certain criteria set forth by Canadian immigration.

Not everyone qualifies for a super visa. This visa is perfect for people who are nationals of countries which are not visa exempt. Meaning people from these countries have to apply for a temporary document before attempting to enter Canada. Some of these countries are Peru, South Africa, Afghanistan, Iraq, Iran, Senegal, Cuba, Russia, Brazil, Egypt, India and Pakistan and so on. There are many countries which are visa exempt, meaning nationals from those countries do not need to have a temporary document to enter Canada. Some of those countries are France, Germany, Singapore, Spain, Republic of Korea, Netherlands, Bahamas, Italy, and Australia and so on. Remember, the visa exempt countries can also apply for a super visa; however they will be issued a different document from immigration which would allow them to visit Canada for two years at a time.

There are many reasons immigration officers would refuse super visa application and some of these reasons are:

You have 3 options: you can reapply, ask for reconsideration or appeal to the federal court. Reapplication is the best route to take as you simply re-apply with a stronger and more complete application. Keep in mind, if you want to reapply, you have to make sure that you explain why you are reapplying and if you submit new information then you have to explain why this information was not submitted the first time around. When you receive a refusal letter; immigration officer will outline the grounds based on which the refusal was conducted. Use those grounds to make your reapplication stronger.

If you believe that the immigration officer made a mistake in refusing your application for super visa, you can ask for a reconsideration of the same application. Be prepared to explain why you think an error in law was made on their behalf. Remember, if you request a reconsideration of your application then you cannot add new information to your case. However, you can do this if you reapply.

Lastly, you can appeal your case to the federal court of Canada. This is not recommended as it highly costly and time consuming. Reapplication is the best option for super visa applications unless you have been told otherwise in the refusal letter.
