What is a conjugal partnership?
Immigration Canada defines a conjugal partnership as individuals who have been in a marriage- like commitment with a permanent resident or Canadian citizen for a period of minimum 1 year but who currently resides outside of Canada. Special circumstances prevent these partners from living today.
Important note:
The Canadian government recognizes both same sex and opposite sex relationships as conjugal partnerships.
Sponsoring your conjugal partner:
In order to sponsor your conjugal partner you must meet the requirements:
- Must be at least 18 years old
- Must be either a Canadian citizen, permanent resident of Canada or a Registered Indian
- Must reside in Canada or intend on residing in Canada,
- Must provide sufficient evidence that they have not received social assistance from the Canadian government previously (with the exception of disability)
- Must prove that they have sufficient funds to provide basic necessities for their Conjugal partner and any dependent children
- Sign an undertaking with the Conjugal partner
Qualifying for a conjugal sponsorship:
In order to qualify for Conjugal partnership, both partners must:
- Prove the ongoing and genuine relationship between the partners for a minimum of one year
- Must have as many combined affairs together while considering the distance
- Must show that living together was not possible due to circumstances out of the control of both partners
Both partners must meet the eligibility requirements for the relationship to qualify for a conjugal sponsorship. Immigration Canada will also ask for many supporting documents to prove that genuineness of the relationship.
How to prove the genuineness of a conjugal partnership:
Conjugal partnerships stand to be very difficult to prove to Canadian Immigration officers. With the distance between partners, the genuineness of the relationship takes many pieces of evidence to prove. The more physical evidence/documents the better your chances to convince the officer of the validity of your relationship
Examples of supporting evidence:
- Correspondence between partners: text messages, call logs, facetime, whatsapp, emails etc
- Travel tickets, flight itineraries, receipts
- A written statement from the conjugal partners explaining the progression of the relationship and the circumstances preventing them from living together
- Photos showing the visits between partners ( different times and places)
- Written statements from family and friendships attesting to your relationship
- Copies of joint assests
- Receipts and/or photos for gifts given/received
